Scope
This Agreement details the licence Trivela Learning Ltd ("we" or "us") grants students, teachers, tutors, and/or guardians and parents (Users) and governs their use of the Trivela game website and Trivela game, together known as the “Platform.”
Acceptance of Terms
By subscribing (whether on a paid, gifted, discounted, and/or trial basis) to and/or using the Platform, Users are agreeing to the terms below ("Terms of Use").
Parental or Guardian Consent for Children Under 13
For children under the age of 13, parental or guardian consent is required for the child to access and use the Platform. By allowing a child under 13 to use the Platform, the parent or guardian confirms they have read and agreed to these Terms of Use and the Privacy Policy on the child’s behalf. The parent or guardian will be responsible for monitoring the child's use of the Platform and ensuring compliance with these terms. If permission is not provided, the child will not be allowed to access or use the Platform.
Changes to Terms
We may update these Terms of Use from time to time. We will always try to inform our customers in advance of any material changes made to the Terms of Use by email communication. Any changes will be posted here, so please check back regularly.
Privacy
By using our Platform, you also agree to our Privacy Policy. Please review it to understand how we handle your personal information, particularly in relation to children under 13, whose data we will only process with parental or guardian consent.
Ownership of Content
All materials, and all materials displayed on the Platform, including without limitation all information, text, materials, graphics, software, tools, results derived from the use of software and tools, names, logos, and trademarks on the Platform (“Content”) are protected by copyright, trademark, and other intellectual property laws unless otherwise indicated.
Copyright in the Platform (including text, graphics, logos, icons, sound recordings, computer code, and software) and the Content is owned or licensed by Trivela Learning Ltd (Company Number 15801241).
Except as expressly authorised by these Terms of Use or by legislation or statute, Users must not:

Adapt, copy, reproduce, store, distribute, print, display, perform, publish, or create derivative works from any part of the Content; or

Commercialise any information, products, or services obtained from any part of the Content.
Users must not modify, copy, reproduce, republish, frame, download onto a computer, upload to a third party, post, transmit, share, or distribute this Content in any way except as expressly provided for in these Terms of Use or with our express prior written consent.
Users must not use the Content for commercial purposes without first obtaining our prior written consent.
User-Generated Content (UGC)
If you upload or share any content (like comments), you let us use it as needed to operate and improve our services. We may share your feedback publicly unless you tell us otherwise.
Code of Conduct
Please respect our rules:

Use the Platform and its Content only for personal or educational purposes unless you have our permission for commercial use.
Subscriptions
In order to access and use the Platform, all Users must have a valid subscription or trial. All access and use of the Platform is strictly limited to the User's subscription period (or where applicable, trial period). If a subscription period (or trial period) expires and the User has not applied for a new subscription, the User's account will be immediately terminated.
For children under 13, subscription and use of the Platform must be initiated and approved by a parent or guardian. All student/child data will be automatically deleted 90 days after the expiration of a trial or subscription if the parent or guardian has not subsequently renewed it.
Subscriptions are not transferable. We reserve the right to temporarily suspend and/or cancel unpaid subscriptions. Users of the Sites and/or Apps are liable for their own internet usage and mobile device charges. It is the responsibility of Users to ensure their computers, mobile devices, and internet access are sufficient to access the Platform.
Any User found to be intentionally misusing the Platform (e.g., hacking or sending fraudulent results) will have their subscriptions revoked without refund. We reserve the right to change our subscription prices upon any renewal.
In certain circumstances, we may offer discounts to Users, including on a needs’ basis. These discounts are discretionary and based on information provided by the User. We reserve the right to immediately terminate the account or withdraw the discount if the information is found to be inaccurate or the User’s circumstances have changed.
Limitation of Liability
We strive to provide accurate information and uninterrupted service, but we do not guarantee it. We are not liable for any losses resulting from your use of the Platform.
Indemnity
All Users agree to indemnify us and our directors, officers, agents, employees, and contractors and keep us and all of them indemnified against all losses, actions, proceedings, costs, expenses (including legal fees), claims, and damages arising from any breach by the User of the Terms of Use.
Termination
We may terminate access to the Platform at any time but will give prior written notice. These Terms of Use will nevertheless survive any such termination.
External Links and Tools
Our Site may link to other websites or use third-party tools. We're not responsible for their content or services.
General
If something beyond our control happens, we are not liable. Not acting on a breach doesn't mean we waive our rights. If part of these terms is invalid, the rest remain in effect.
Governing Law
These terms are governed by the laws of England and Wales. You agree to the exclusive jurisdiction of their courts, but we may take action in any relevant jurisdiction.
